Court deems it unnecessary to issue an order to arrest state minister Diana Gamage

Colombo Chief Magistrate Mr. Prasanna Alwis says that no arrest order will be issued for State Minister Diana Gamage. The Magistrate stated that he is making this order as the Criminal Investigation Department has the power to take measures related to the arrests under the offenses of the Immigration Act.

The plaintiff Oshala Herath and the aggrieved parties’ lawyers in this case had previously stated before the court that the Criminal Investigation Department is not taking any steps to arrest Mrs. Diana Gamage despite the existence of sufficient evidence and requested to issue an arrest warrant in accordance with the powers given to the court under Section 32 of the Criminal Procedure Code.

Giving the verdict, the Magistrate said that the investigating officers have the authority under the Criminal Procedure Code to deal with it. Therefore, the magistrate said that it is unnecessary for the court to issue an order in this regard.

The magistrate then ordered to lay by the case.
